  • Guardianship is defined and described under Article 81 of the Mental Hygiene Law and petitions are heard in eithe Supreme Court or Surrogate's Court. Essentially, the person for whom the guardianship is sought must be judicially declared incompetent in order to have a guardian appointed. The subject of the guardianship is usually represented by the Mental Hygiene Service of the Judicial Department in which he/she resides.
