Yes. You, as a driver, are to be in control of your vehicle at all times. If it were a person there instead of a car, you would be guilty, so of course a car would be your responsibility.

Of course. That doesn't mean that the policeman taking the report couldn't fine you for your own infraction.

Both are at-fault. Here is another example of why............... Man driving on the interstate had a flat tire and was trying to make it to an off-ramp to a service station. he was traveling 45 mph in a 70 mph zone. Dump truck comes around a corner, on the interstate, and plows into the rear end of the flat tire auto. Who is at-fault here? Both are. the flat tire driver for impeding traffic and causing a serious traffic hazard and the dump truck driver for failing to have his vehicle under control.
