Yes, it's mail theft (if that's the correct term). It's also forgery.

your married so they will probably skip the mail thing. it is however forgery and check fraud, 2 things that they frown upon most in the legal community.

It depends on the state in which you live and whether it's a common property state. While married or not it's a crime, often the mere fact that the suspect is a spouse causes the case not to be pursued.
